September 7, 2010 (Sampurn Wire): The order challenging Adnan Sami and his new wife Roya's right to stay in their home was overturned by the honorable Mumbai High Court on Tuesday.
What the High Court ruling means in every day language is that the new Mrs. Adnan Sami won't be asked to leave her home. Says the jubilant Adnan, "They (Sabah and her legal counsel) were not given interim relief. The honorable judge said, this was a matrimonial case. Even the courts could see the absurdity of it. And you know something? I didn't tell Roya this morning that the hearing on her future—whether she can stay in her husband's home or not—was to be decided this morning. I wanted to inform her after the verdict."
Roya is over the moon. Speaking in fluent Hindi, the German-Afghani wife says, "Main bahut bahut khush hoon. Ab main chain se apne pati ke ghar mein so sakti hoon. When I first heard that she had asked for me to be evicted from my husband's home, I wondered, how could this happen? Unke saath to meri koi dushmani nahin hai. Maine unhe ek hi baar dekha hai. I wondered which court in the world could possibly ask a wife to leave her husband's home. Yeh mere liye naya hai. [That the court should tell a wife to leave her husband's home was new to me."
Getting emotional about her husband's trauma during the past year Roya says, "I am so happy to see Adnan happier now. He can do his composition in peace again. Mashallah, he's doing his best work again. Losing his father was traumatic enough for Adnan. And then to have all those other problems on his head..."
Roya hopes Sabah will accept the peace offering through the letter that Adnan has sent. "Adnan ne haath badhaya. Ab ummeed hai woh haath pakad lengi. Everyone has a peaceful corner in their heart. Maybe that corner gets neglected when one is angry."
Adds Adnan's lawyer Vibhav Krishna, "They (Sabah and her legal help) had taken out a writ petition whereby by the order of the Family Court, Adnan should not be allowed to stay in the disputed house. And neither should his wife be permitted to stay. Basically they were fighting against Adnan. But they wanted an interim relief against Roya. Therefore I told the honorable court that what they (Sabah, etc) cannot achieve directly they surely cannot achieve indirectly. If they wanted to make Roya a party, give her a chance to talk. Only after that please pass an order against her. The honorable judge was very appreciative of my point. They first approached a criminal court. Then they withdrew their application from the criminal court and went to a family court. The entire purpose is to harass the couple. They've been recently married. Permit them matrimonial bliss at least for some time. The denial of interim relief allows Adnan and Roya to stay in the house and fight his case from there peacefully."
