HC comes to Khushboo's help

The Madras High Court on Wednesday dismissed a plea seeking a direction to the Police Commissioner to register his complaint against actress Khushboo for her remarks after the results were declared in the Assembly polls.

Justice T Sudanthiram, while rejecting the plea of advocate V Arivalagan of Salem, said on Wednesday that no offence of causing intentional insult and breach of peace could be made out against the actor.

“Section 504 is non-cognizable offence and it is not even made out in the complaint,” the Judge said and dismissed the petition filed by Arivalagan, who said Khushboo was quoted by a Tamil daily that the DMK's defeat in the April 13th elections was not just of the party but of the people of the state, who would face hardships in the next five years while the AIADMK was in power.

Though she had freedom to express her views, the liberty should not adversely affect the freedom and sentiments of others, he said, and wanted the high court to direct the Salem police to register a criminal case punishable under Section 504 (intentional insult to provoke breach of peace) of IPC.
