Kris Humphries is planning on ending his marriage to Kim Kardashian without a fight, it is reported.
The 26-year-old is moving on from the "devastating" split from the reality star and does not intend on trying to save the marriage anymore.
People magazine claim that contrary to reports the basketball player is refusing to sign the legal documents, the 6' 9" athlete is in fact ready to print on the dotted line.
"He will be signing the papers," a source close to Kris said adding that there was no war between himself and his estranged wife.
The insider added that Kris has not hired a new lawyer as previously reported, but that Lee Hutton was his attorney all along.
Kris had flown to his home state of Minnesota to lick his wounds after being surprised at Kim's divorce filing on Halloween.
But he flew back into New York this week, where the couple had been living, and was pictured out on the town last night.
Kris was seen having a low-key dinner with a male friend, his manager and his manager's wife at Serafina restaurant, which was a favourite that he used to go to all the time with the Keeping Up With The Kardashian star.
Us Weekly reports that the group were deep in conversation and the unemployed basketballer did not look happy.
"Kris looked so depressed," the eyewitness said. "He looked like he was going to cry in his pizza, sat at the same table he used to sit with Kim."
"He looked so sad and gloomy. Not the happy Kris who used to tease and laugh with Kim at the table. His friends looked like they were giving him encouragement they were trying to cheer him up."
