(Cover) - EN Showbiz - Halle Berry's trespasser has been charged with felony stalking.
Richard Franco, 27, from California was arrested on Monday night after allegedly going on to the actress's property illegally three times in the past week.
He was arraigned today at the Foltz Criminal Justice Center in downtown Los Angeles charged with one felony count of stalking.
Halle was awarded a temporary restraining order against the man yesterday which states that he has to stay 100 yards away from the Oscar winner, her family, her car, her workplace and her home.
He had scaled the wall of her Hollywood Hills home and entered her back yard.
The Monster's Ball star has stated in legal documents that she does not know who Richard is and has "no desire to have any contact with him".
"This person has invaded and trampled upon the most fundamental sense of security I have and I am extremely frightened of him and what he might do to me or those I love.
"I am also informed that Franco has a criminal history of violence, theft and drug offenses," Halle wrote.
The alleged stalker is currently on probation after pleading no contest to a misdemeanour battery charge in June which he faces three years in prison for if convicted.
He is still in custody on $150,000 bond. (C) Cover Media
