(Cover) - EN Showbiz - The woman who accused Matthew Fox of assault has withdrawn her case against the actor.

Heather Bormann, a Cleveland, Ohio bus driver, claimed in her own lawsuit back in September that the former Lost star tried to get on to the party bus she was driving and things turned ugly.

The mother-of-three alleged that Fox hit her after she told him to get out of her vehicle and struck her in her breast, arm leg, and private parts.

Entertainment Weekly reports that Bormann's former attorney chose not to represent her anymore in April, claiming "she intentionally failed and refused to provide full and timely cooperation and information."

As of today Heather is no longer seeking damages for assault from the actor.

Fox filed a countersuit last fall against Bormann stating that she made the story up and the fabrication adversely affected his career.

The actor was charged with driving under the influence and driving without a licence in the state of Oregon a few weeks ago. (C) Cover Media
