Katherine Jackson has filed a lawsuit on behalf of herself and the late pop stars children Prince Michael I, 13, Paris, 12, and seven-year-old Prince Michael II, known as Blanket. In it, she claims AEG Live, who were promoting Michaels ill-fated This Is it London residency, breached its agreement to provide physical care for the singer. Michael had been due to complete a series of shows in London, but died before they took place.
Katherine claims AEGs contract with Michael created a legal duty for AEG to act reasonably toward the physical well-being of Michael Jackson", something she claims they comprehensively failed to do.
The paperwork also claims AEG was negligent in hiring Dr. Conrad Murray as Michaels personal physician.
"AEG did not provide a doctor who was truly looking out for Jackson's well-being and did not provide equipment," the legal papers read.
Murray is currently facing charges of involuntary manslaughter for his role in Michaels death from acute Propofol intoxication by intravenous injection of another in June 2009.
The lawsuit also mentions the emotional distress to Michaels son Prince, who allegedly witnessed his fathers death. "He was put in a position as bystander to these tragic events, the documents read.
In addition to AEG Live, the lawsuit mentions Kenny Ortega, who produced the planned concerts for Michael, as a defendant.
Brian J. Panish, who filed the legal papers on behalf of Katherine, said the Jackson family was keen to reveal the truth about Michaels last days and death.
"The purpose of this lawsuit is to prove to the world the truth about what happened to Michael Jackson, once and for all."
The new lawsuit comes as Dr. Murray moved to have Michaels father Joe Jacksons wrongful death suit against him dismissed because Joe had no recourse to sue as he was not one of Michaels beneficiaries.
A hearing on Murrays motion is set for October 18. In the legal papers Murray has filed, he questions why Michaels other physician Dr. Arnold Klein is not mentioned in any suits. In his new documents, Murray quotes various passages from Joes suit that clearly state Arnold was medicating Michael up until a week before his death.
"The plaintiff [Joe Jackson] does not explain why, given these allegations, Dr. Arnold Klein is not a required party to be added to accord proper relief, Murrays motion reads. (C) Cover Media
