Brooke Mueller is reportedly refusing to enter rehab for a long stint, as she is being advised by medical professionals.
The 34-year-old ex-wife of Charlie Sheen was arrested over the weekend in Aspen, Colorado and charged with felony drug possession and misdemeanour assault.
But RadarOnline is reporting that the troubled mother-of-two is refusing to enter an in-patient facility for the nine months she needs to do.
The site claims that Brooke does not want to be away from her two-year-old twin boys Bob and Max for that amount of time.
Brooke has suffered a drug problem for several years and is said to have battled an addiction to crack cocaine and desperately needs long term help.
"Brooke has done rehab on her terms in the past," an insider told the site. "Thirty days isn't enough for an addict like Brooke.
"Brooke is calling the shots, and not listening to her family, or medical professionals that are telling her that she needs to be at an in-patient facility for at least nine months, and not as a day patient as she has done in the past.
"Anything less than nine month is a disservice to Brooke, and frankly, is a total waste."
The former actress is said to be "simply powerless to her addiction right now".
"Brooke is the most amazing, caring woman, and mother, when she is sober. Brooke just can't get in control of her disease, and if she doesn't finally surrender to it, and listen to what her family, and medical professionals are telling her to do, she could die," the source added grimly.
Meanwhile Charlie, who was on a trip to Columbia when Brooke was arrested, has reportedly told friends that he is going to take control of the situation and get his boys so they can stay with him while their mother recuperates.
Brooke had custody of the two-year-old twins the night she was arrested and had gone out partying leaving them with the nanny. She and the children are reportedly back in Los Angeles now.
Charlie is said to have paid Brooke's $11,000 bail and she is due back in court on December 19.
Brooke recently sought help for her addiction issues at an alternative treatment centre in Mexico.
