(Cover) - EN Showbiz - Lindsay Lohan has walked free from a California jail after a judge ruled she had been unlawfully detained.
The actress was taken into custody yesterday when Judge Elden Fox denied Lindsay bail after she failed two random court-ordered drug tests. However, following an appeal from Lindsays legal team a judge for the Los Angeles County Criminal Courts later threw out the original ruling and set the stars bail at $300,000. Lindsays bail was posted and she left the Lynwood Correctional Facility within hours of the ruling last night.
An order has been signed by Judge Patricia Schnegg granting writ of habeas corpus, court spokesman Allan Parachini told People.
Under the reported terms of her bail, Lindsay must be fitted with a SCRAM alcohol monitoring bracelet within 24 hours of her release, avoid being around known drug users, submit to random searches and not take or possess any controlled substances.
Lindsays lawyer Shawn Chapman Holley filed an appeal against Judge Foxs ruling soon after she was taken into custody, arguing the 24-year-old was unlawfully refused bail because hers was a misdemeanour case.
I think case law is clear that she is entitled to bail. That is all, Holley told UsMagazine.com.
Lindsay was ordered to appear before Judge Fox yesterday after a warrant was issued for her arrest on Monday after she failed at least one court-ordered random weekly drug test.
The troubled star spent 13 days in jail and 23 days in rehab earlier this year after she violated the terms of her 2007 conviction for Driving Under the Influence (DUI).
Judge Fox agreed to let Lindsay leave her court ordered 90-day rehab stint early but warned her she would be sentenced to one month in jail for each drug test she failed or missed.
It is believed Lindsay tested positive for cocaine and Adderall - a drug used to treat ADHD.
Lindsay admitted she has a problem when she failed a drug test just weeks after she was allowed to leave rehab early. Substance abuse is a disease, which unfortunately doesn't go away over night, she wrote on her Twitter account. I am working hard to overcome it and am taking positive steps forward every day.
